Spousal Support

Providing Counsel on Spousal Support Issues

If you are facing divorce and an uncertain economic future, you may have thought about spousal support. You may be the spouse with steady employment or a larger income, and may be asked to pay spousal support.

Texas is one of the few states that limits spousal support, unless you are disabled or have a disabled child.

In order to qualify, you must have been married for at least 10 years or have been victimized by domestic violence. There are other factors as well, which experienced family law attorney Lauren Cain can help you identify.

Providing Clear and Convincing Evidence

The law treats men and women equally. If there is a large disparity in income and earnings potential, the wealthier spouse will be able to deal with the divorce financially, much more quickly.

Texas legislators designed the spousal maintenance law to provide support for up to three years, so that parties can meet their reasonable needs and catch up with career skills and training.

Besides meeting the other qualifications for spousal support, a woman or man who wishes to be awarded spousal support must demonstrate economic need. The maximum allowable spousal support is the lesser of:

  • 20% of the providing spouse's average monthly gross income or
  • $2,500 per month
