Prenuptial/Postnuptial Agreements

Drafting, Reviewing and Challenging Prenuptial Agreements

Some people are disdainful of prenuptial agreements and consider them a prelude to divorce. At the law office of Lauren Cain Attorney at Law, we know that prenuptial agreements can strengthen a marriage and minimize conflict between the bride and groom and between the couple and their family members.

Our family lawyer, Laruen Cain, believes prenuptial agreements make a great deal of sense, particularly for couples entering second marriages and for people with large estates or differences in income or assets.

Prenups for Second and Subsequent Marriages

If one or both members of a couple have children from a previous relationship, the children can be concerned about whether the new spouse is after their parent's money.

Will the stepparent get half the estate in a divorce? Will there be anything left for the kids?

A well-crafted premarital agreement can help minimize conflict between a new spouse and the stepchildren. When children know that plans for the future are reasonable, they have fewer reasons to dislike or be suspicious of the new person in their parent's life.

Disparities in Wealth

When there is a large discrepancy in income or assets between the bride and groom, a prenuptial agreement can protect the assets of the wealthier individual while being fair to the other person in the property division agreement, should the marriage end in divorce.
